Well, technically they aren't allowed to...but not every scenario fits nicely into the one laid out by the book. Sometimes moderators need to use their better judgment and bend hte rules a little bit.

But the reason given was "cheating" not arguing too much, I find it funny how people admit to cheating have a linked gamertag and dont even get banned from the forums, yet a person without a linked gamertag get banned for "cheating".

I don't recall seeing that rule. I do recall seeing that the discussion of cheating is a no-no, but I don't remember seeing "All cheaters will be banned from the forums permanently."

Yes, he did. There is a large backstory to that particular case, and it is irrelevant to the topic at hand, besides being none of your business. Besides, I'm sure we'll hear from him again - that was not his first account, nor will it likely be his last.

The rule is actually that people advocating cheating on the forums are dealt with harshly. Sometimes that means a ban from the forums. Sometimes not. It depends on a lot of factors. Moderators are free to exercise judgement, and some are less forgiving than others. Their job is more art than science. They are getting a way to give "warnings" out to people in the major redesign (which will have effects other than a slap on the wrist that I can't tell you about at this point) - so they'll be able to be more flexible in the future about this kind of thing. That and a certain other tweak to their ban tools will help them be more consistent when more than one mod is working at once.

Got in one little argument, and the mods got scared,
they said "You're gonna get banned and your member title'll be bare!"

It's high time we had improved discipline proceedures on the forums. Looking forward to what's ahead in the site update.

Bungie makes the ToU, Moderators interpret the ToU and make the rules. if they don't believe someone has broken those rules, then there is no ban.

Some moderators don't put forth extra effort to hunting them down. Nothing against them, but if they're not causing problems, then why waist time and effort just to get rid of them?

If they cause problems on the forums, they are removed promptly. Elsewise, it is a matter of the mood they're in...
