That sucked so badly. With Halo Wars being announced shortly after it's shutdown, I can't help but wonder if there wasn't something fishy going on...

Either way, montages and machinima seem to be fine thus far, no one's gotten pinched for making them. Unless you sold them*.

*Does not apply to Red Vs Blue, they have deals with Microsoft worked out.

Halogen's shutdown was entirely motivated by Halo Wars. Don't kid yourself.

I too would like to see this issue hammered out in more detail, as I've been working on a Machinima script for a considerable length, but have been rather wary of continuing forward due to this particular grey spot...

Halogen was just bad luck.
If Halo Wars was in another genre, it would have been fine.

But, definitely, we need some actual info.

This is something I was thinking about a while back. I really hope the issue hasn't been dropped. Now that the "don't make money and you'll be fine" rule has it's limitations, it would be really nice to know what those limitations are. I've had some ideas myself, and though I haven't pursued them, I can see myself doing something in the future. It would be great to be able to know for certain whether what you are doing is allowed. In my opinion, Microsoft is currently asking us to ask for permission with any project we want to work on. This would be okay, but unless you are offering a deal that would give them a profit, I don't think they really respond to much of anything.

I could smell the burning morality of the Microsoft legal department from my house...

It would be nice to know things like this, especially seeing how huge the Bungie montage/machinmia community has become over Halo 2's lifetime.

In all seriousness, if people are actually looking for someone to blame, they should probably look to the executive department, not the legal department.

It's just that...there's so damn many of you guys! Chances are, if we blame a lawyer, we have a better chance of being right than if we were to select a different occupation. That is, of course, if "wrong-doer" isn't an occupation.

What about janitors?

I bet Microsoft as a whole has more janitors than anything else. I'm sure those janitors came in and shut down HaloGen.

You know, speaking of intellectual property, I wonder if Microsoft actually goes after the lowlife scumbags who leaked alpha and (today), beta videos onto the internet. Bungie has said that they have numerous tools at their disposal by which they can analyze leaked videos to determine who the leaker was, and I would hope that Microsoft would take advantage of Bungie's abiities in this area.

I have the lowest regard for those people who exploit their employment with Microsoft by taking advantage of the opportunity to play games earlier than everyone else without paying and then thank Bungie for the opportunity by posting videos on the internet in violation of their non-disclosure agreements. How hard is it to keep your word and not break a contract?

I just sincerely hope that Microsoft goes after these jerks who have no real love or affection for Bungie and simply got lucky enough to land a job as a Microsoft desk jockey. I hope Microsoft goes after these people with the same zeal and gusto that they destroy the creations of legitimate Bungie fans who create a free Halo-based RTS mod because they loved the games so much.

Nah, it took me 10 minutes to find enough information in that video to be able to ascertain who the leaker was if I were Bungie. All they need to know is whoever was on the red team playing alongside "jimmyfargo" and "garyc" and against "nutzsquirrel" and El Sweepador. His or her thirteenth game of the Beta was on the map, "Last Resort." All of this together should be enough to provide indisputable evidence of the leaker. Or at the extreme least narrow it down to two people.

I have not heard of anyone getting fired from Microsoft or Bungie for leaking material. How do you know that they go after these guys and that they get fired?

hm, scary. anyway, I doubt they'll go after you as long as you stay away from big companies. they're the ones who make you big and well-known. as long as it stays somewhat private, people won't know about it. sure, that's bad, but at least you won't get sued!

You're right, mostly. If they can't see you, they can't do anything to you. But in my opinion, that is a horrible way to have to approach a project. Should I really have to worry that I might be too good, that what I am doing will become too popular?

No... people shouldn't have to worry that what they are doing will be shut down if they actually achieve their goals. There should be some way of knowing before you start whether you will be able to finish.

So, yeah. Some sort of guidelines or rules or something would be nice to have.

I'm not that active, but never dead.

Having searched bungie's news archive for the last 15 minutes, I'm just going to say that I remember in one of Frankie's weekly updates he talked about some of the legal aspects of the Halo Franchise and detailed some of what halo fans could and could not do. I just cannot find the article for the life of me.

I think you missed my poorly stated point. It's not about not trying to make it superly-awesome, but in reality, that doesn't make you big. Companies do. Money does. NOT good ideas. it's reality. you got money? you wanna make a movie? kay, we got Beonce, she can be the mom...

Seriously. So just do your own thing, and I'd be happy with a somewhat small community of fans. as long as you don't go money-making, or money at all being moved around, you'll be absolutely fine.

and good for you, you should go for it. I'd be glad to help if it's not modding. i just do non-modding machinima. although a few mods never hurt. ;-)
