I think it shouldn't really matter if it's modded as long as they aren't doing anything with modding on games. I DO have a modded Xbox, but I DO NOT use it for Live. I have another for that. There really isn't a point, people will find a way around it anyways.

UPDATE: Defnop552 has confirmed he has fixed his dick.

Its still voiding a waranty for modding but if your using it for fun- offline perpouses I don't see who it would hurt.

I personally have played at a friends house on a modded xbox and we never go online.

Also dark if you want to mod on an online thing try Xbox Connect, they have a special channel for modders to play their own games on so most of the time there are no modders in XboxConnect except for that 1 channel.

i'm sure xboxs main concern is the money factor...since so many modded xboxs save games on their harddrive and not paying $50 a game...
