Well, for the Halo 3 beta if you're caught modding it whatsoever, you do get your 360 banned. This was told in a weekly update not long ago (the week before last if I'm not mistaken.)
I'll see if I can find/link it.
edit
Ok, I can't seem to get the link (for some odd reason) but I could at least track down the quote based on people copy/pasting it to other threads.
This is from SketchFactor I believe:
[quote]Major Nelson and Gamerscoreblog posted reminders today that people who log onto Live using modified consoles are being dealt with. As more and more people pour into the Halo 3 Beta, please take this warning to heart. Using modified content and hacked boxes is against the Terms of Use for Xbox Live and doing so will result in your console being permanently banned from the service. Forever. For all games.
If you get an error message "Status Code: Z: 8015 - 190D" it means you are done playing Xbox Live on that console. Congrats.
Yeah, I knew about modders getting their just desserts, but other cheaters, such as bridgers, standbyers, etc just get the slap on the wrist (aka gamertag ban).
That is what has always been most prevalent as far as cheating goes. Most people have seen modded games at some point, I think. EVERYONE has been affected by standbyers/bridgers.
But, like I said, MS would never ban Xbox's for that one. It would cut into their profits.
