Technically it would not be considered "downloading" when you install from a CD. Installing from a CD is more like copying the info from the CD to the hard drive. Downloading means to acquire a file from another computer/server through the use of the internet.
Anyways, I've said it before and I'll say it again: If you have a valid, purchased copy with a valid, purchased CD key, then you can download the game for your own purposes. Just be warned that it is really not as easy as you think. I believe Bungie added a copy protection system after the 1.03 patch. (Although I may be mistaken on the version number)
Before the words "software pirate" start getting flung around like so much monkey poo, let it be known from someone with too much time on their hand who actually did a little research, that there are legitimate uses fir No-CD patches, Cracked .EXE's, and CD images. Not everyone who downloads and uses them does so for illegal gain. I've No-CD patched many of my games in an effort to reduce wear and tear on my rather large collection of games. It's much more sensible to use the CD once then pack it away so it won't be damaged and use the program with a No-CD patch or whatever.
I'm sure some of you remember the things I've said to people asking for CD keys or places to download the game. There is a difference between a little twit looking for a free game than a person who has a legitimate excuse to be asking about it. And I still hate software pirates. They make things much harder for the rest of us.
