Hey everybody,

Recently someone was permabanned in the Flood forum (I won't name anybody) for posting a link to a full movie. The moderator's (still won't name names) reason for the perma was Linking to pirated material is getting people permabanned in the Halo 3 forum. I don't see how I can treat this any differently.This brought an interesting question into my mind. If "linking to pirated material" gets you a permaban shouldn't people who post links to anything on youtube or google videos that is copyrighted, i.e. music videos, music, or clips from movies or tv shows, also suffer the same fate?

I'm not disagreeing with the moderators ban in any way, I am honestly just curious to the rules. I tried PMing the moderator but didn't really expect a reply, so I figured I'd post here and see if anybody could give me some insight.

More or less pirateing is getting something online for free when you normally have to pay for it.
I'm not too sure about sites like youtube and such, cause from what you said its pretty much like I explaned above, but its to a lesser extent.
I'm not 100% sure on the rules on this since I've really never seen any problems with it in the past.

The thing is, most of the stuff posted on youtube is stuff you can find for free on the internet (legally). Also, they don't take credit for making it (I hope).

The full movie posted on the internet I know is illegal, not sure how youtube hasn't realised that, as is some of the other stuff on Youtube you'll find. Its up the the person to decide whether its illegal or not and his/her decision to post it. He/she just made the wrong choice.

I guess we have to wait for a mod or Archonos to settle this one completely for us.

You can name names, I made the call. The member can remain nameless for their own privacy.

It was a link to a google-video of a full-length feature film. I saw nothing at the link that it was posted with permission, and according to my interpretation of the Terms of Use and Code of Conduct, providing links to illegal material is a bannable offense.

Seems fair enough.

There are no irrelevant quotes of historical figures here. Neither will you find any links, chain posts, memes, clan advertisements, self-promotions, or the tiniest of ASCII pictures.

So go away.

Yeah, seems fair to me. Clips on Youtube are kind of a gray area sometimes, but a full length movie is pretty clearly illegal. If you're thinking of posting something that you're not sure of the legality of, I would just play it safe and not post.

Is there any appeal to this at all? Posting a full movie equals automatic perma without ever being able to come back?

And thanks for clearing that up. So to my understanding, clips = not illegal, that's all I really was wondering.

I'm not really sure about this specific incident. It sounds like a pretty solid judgement call but that's not what I'm here for.

I'm here to comment that YouTube is actually pretty damn good about being policed up for copyright violations. There are a lot of small clips out there that I'm sure are a violation in some way but they also help spread the name of the content being uploaded. Most direct violations are removed the instant they're found.

yeah, it's not perfect, rb5elite. i'm just pointing out that ate-oh-ate's bad judgement has nothing to do with what goes on on other sites. i really don't have a problem with small clips and have become a bit more open to piracy in general but that's another discussion which would go horribly on these forums. trying to distract the blacklist with a melodramatic topic about something tangently related sounds like something i'd do. grow up, people
Actually it wasn't me that posted the video, I just saw it on the forum. The question of whether posting clips of material that could be copyrighted is illegal was honestly a question that I had in my mind.

It in no way was trying to "distract the blacklist." I merely brought up the blacklist as an example not for the effect of melodrama.

Fan-recorded clips from in-game would be allowed, unless they were of the cut-scenes. Basically, if it shows any plot other than your own, you can't post it.
Fan-made videos from TV shows, movies etc are generally illegal, and YouTube will (and has) remove them at request of the owner of the materials. But they don't give a crap about it unless someone complains. Generally, however, the owner will allow it to remain, as it generates publicity. If a full vid of an episode or, as mentioned, a movie were posted, it would likely be taken down, even without the request.

Any pirated or boot legged material not out yet officially on DVD or tape = teh bad if posted here. But a permanent ban? That's a different story. I seriously believe it should be a temporary ban. A perma ban in my honest opinion, is not necessary and is out of a line a wee lil' bit.

I'm not sure how can say that with the rules clearly stating: Neither Bungie nor Microsoft allows behavior or content related to illegal activities. If you violate the law, you will be responsible for the consequences. You cannot use Bungie Web Sites to publish, post, distribute, or disseminate defamatory, infringing, obscene, or other unlawful material or discussion. That includes full length movies. (By the way, if you guys haven't read the CoC, you really should get to it, not only that you'll be much safer on these forums, but you'll also giggle in delight.)

And more importantly (;-D), it was really Impurity who was banned, then I'd have lost respect for everybody in HFCS (not really).

Oh, of course. Because, you know, it's not as if he already gets away with a lot of things as it is because of his prior moderator status. This wouldn't even be close to the first time he's been banned. (Of course, I don't know why he was banned this time, and that's really off-topic for this thread.)

They actually replied and instead of removing the link, their reply was along the lines of "but I HAVE to do this", as if the joke they were attempting to make was more important than the rules that they were violating.

He left out that part when he told me...
