it wont let me join my friends party when he starts the party. It isnt just one person it does it with my other friend to but then all 3 of us can join someone elses party. also some times when we are in a custom game we can not hear eachother talking at all but other people can hear us

any help would be very nice

I had the same problem. (I'm italian so sorry for the bad english). Microsoft divides people depending on the your network/router/modem capabilities. If you do the "check network" thing on xbox dashboard you will see that you can be something like "open" "moderate" or "strict"(or something like this). The first type is the best you can make parties with everyone, the second type can make parties with the first one and with other moderates, the last type sucks and can only be invited in parties made by an "open" one. I can be 99% sure your problem regards this stuff.
Anyway if this is your problem you can try to solve it like I did.
I have a router, so I downloaded the firmware upgrade of my router and then updated it. The router doesn't loose its settings and I got from "strict" to "open"!!!!
