4 shots to the head with the human sniper rifle is more than enough to kill someone but for some reason he doesnt die.....i.e. hes cheating

There could be other reasons, the game could have been really laggy or you just thought you hit him in the head 4 times and you didn't. Whatever the case, wrong forum.

This does not necessarily mean that he is cheating because there are various issues regarding this situation. As for problems where you visually see your sniper rifle shot go through your opponent, this is what Achronos had to say...

Uh, that means that your client thought you hit the guy, but the host didn't. Remember, saved films are from the perspective of the box that recorded them. If you weren't the host, then it is possible that the guy won't die if you're experiencing some lag. The Halo 3 sniper rifle is not as forgiving as the Halo 2 rifle. In Halo 2, the client had an advantage over the host because the client could miss (based on the host's world view) yet still get credit for a hit. In Halo 3, this doesn't work anymore. With the addition of saved films, this means you can pretty much see all the times you and the host don't agree.
Hopefully reading what was stated above helps you better understand what exactly may be going on and why you have been experiencing those occurrences.

^^ Yeah. Also, I have yet to see anything that I wasn't convinced was simply a bit of lag. It's way better than any other MM game I've every played, and I'm sure it will only improve, but I really don't think I have ever run across real cheaters (modders) in the game yet. Next time something like that happens, look at the connection bars on the player list. If more than one isn't green, then you can be sure it was lag. I've had this type of thing happen when all bars were green, and it still just looked like lag to me. Have there been any actual cheaters found yet at all? (not including boosting, taking advantage of spots in maps, or grouping in rumblepit.)

Your best bet for running into problems like this is to simply select the “avoid player” under the report function. This let's Xbox Live know that this player is up to something is up, not to mention makes it less likely that you'll be matched with the player again.

Posting on Bungie.net does not help the problem at all. Trust me, Bungie has more game data than a video could ever provide.
