On forums that are mostly 18+ and that have no such censors, it can get pretty messy sometimes--I would hate to see what this place would be with a bunch of bored adolescents with that kind of power.

Democracy doesn't work when the majority have the collective intelligence of a roasted peanut.

This is why I like coming here. Most forums have their little wars against subforums but self-aggrandize as a whole. But here, it's okay to malign the entire community. Once in a while an Ambassador from the Septagon will even deign to visit the miscreants of H3F with a "<_< >_> whining as usual *namedrop* k bye."

It honestly is not that bad as a whole. Hell, even the regular trolls are intelligent albeit sometimes immature. But compared to some other communities I've been a part of, bnet is wonderful. It really is not that bad.

Now, as far as whether maturity is at a level to allow cursing without censorship, of course not. But very few internet communities with similar demographics are anywhere close to that.

yea they sensor everything now its great. tv, radio, music, its pretty sad. But dont worry its up to us a citizens to make sure our rights are kept. This is why you should never ever, do something just because someone told you to. Listen to people who think they are above you. People who think they know whats better for you then you yourself does. I keep a healthy supply of semi automatic guns in my safe for all the liberals in this country. They can try to silence my freedom to speak , but they will have to make it through my wall of .225's first.

The blam censor on Bnet is the single best feature of the website. It encourages using real language and is a great indicator of who the members who need to be given a timeout are (i.e. - lots of blams in a post = timeout needed.)

If anything, the blam censor should be applied to the entire internet. Achronos, you should get on that.

Not exactly, Tony. American laws do indeed apply here, as do SOME of the laws of many other jurisdictions. The servers are located within the United States, and Bungie is an American company. The laws of the United States apply to it (jurisdiction of laws is largely based on physical location of both yourself and the effects of your activities, rather than the locations of your customers). Because of the worldwide reach of the site, some laws of foreign countries may also apply to Bungie.net, but because the internet is as new as it is, many aspects of this issue are still being worked out in various courts around the world.

To the OP: before attempting to make statements of what the law is, it helps to read the law first. The First Amendment is only one sentence long, so it shouldn't take you that much time. Here is a convenient link.

In case you don't feel like reading it, Achronos's answer was the simplest and most correct statement of the law: the First Amendment to the United States Constitution does not apply here. It states that "Congress shall make no law . . . abridging the freedom of speech, or of the press . . . ."

The very first word of the First Amendment makes it clear that the Amendment applies only to the federal government of the United States. (As an aside, thanks to the Fourteenth Amendment, the First Amendment applies to State governments as well.) But Bungie LLC is neither one of those -- it is a private corporate entity. Therefore, Bungie can restrict your speech on BNet as much as it pleases. Indeed, Bungie could shut down its Bungie.net forums entirely and thereby prevent you from saying anything at all.


I find it amusing when Americans think their constitutional right applies to private sites. I wonder if these people think they have the right to barge into people's homes and spout their views under the guise of freedom of speech?

Bungie is based in the US and so this site has to abide by US laws. If the site were providing a paid-for service, things would get a lot more messy but this isn't the case here.

Foreign laws do not apply to Bungie. It will apply to foreign users however. If I were to do something illegal on Bungie.net that is illegal in the UK, but legal in the US, I can get in trouble because I am bound by UK law. On the flip side, if I were to break US law but not violate UK law, nothing can be done against me because I am not under American jurisdiction.

Not necessarily, One One Seven. I have a client right now who was laboring under that same misconception, and is now facing hundreds of millions of dollars in damages because they assumed that, because they were based in a foreign country and their activities took place in a foreign country, American laws did not apply. They were wrong.

Jurisdictional rules are complex and oftentimes nebulous. Any person or corporation whose activities reach foreign jurisdictions should be careful in assuming that their physical location is the only thing that matters. I'm not saying that somebody is about to go after you for something small that you do on a website that reaches the United States, but, as my client would readily agree, it's dangerous to make broad assumptions about who can and cannot have jurisdiction over illegal activities.

What most people don't understand is that the langauge in the game has a purpose, too tell the story. Halo 3 actually has very little language (ESRB gave it "Mild Language").

On the website, a "blam" filter as its called is necessary. Too many people swear, cuss etc. This isn't exactly a 21+ bar, if your going to swear this isn't that good of a place. Too many people these days compare "Mature" games to 21+ bars, and really they aren't. There is just some cartoon violence, and you find a much more varied audience here. People say it is 17+, well guess what people who are over seventeen don't necessarily want too go too a place where there is swearing, racist langauge and so on. Especially when there isn't a good reason for it.

I'm glad the profanity filter is in place. I'm 18 but chose not to swear,( I do not consider hell and piss a swear). The last thing i want to read is the eff or sh words or the others. Thanks Bungie for the filter.

EH...the only time you need to curse or swear is if you see a soccer ball coming at your face at 120 mph, or afterwards. Otherwise people should be intelligent enough to choose better ways to express their frustration. If not they get blammed into the tar pit.

The ESRB is in not censorship. Its a rating system. You can put whatever you want in a game, and the ESRB will slap a nice little sticker on it to help consumers decide for them selves if they feel that the game they are looking at is appropriate for purchase, therefore, making an informed decision. Its there to help you.

This website is property of Bungie. There house, there rules. And they can break them if they want to.

I love "-blam!-". I've been waiting years for there to be a "-blam!- happens" bumper-sticker in the Bungie store.
