There's always that small chance that He/She who originally had the tag would want to Re-Up on the subscription... so I'm pretty sure when its gone its gone. If I'm wrong please correct me.

Creating a name on the Xbox Website is completely different than creating a GT.
The website will retire these names and accounts pretty regularly to avoid waste. The accounts for XBLIVE are different. Since these members usually go for the yearly accounts they assume people will be On and Off for a while. Imagine it this way.

You create an account by the name of "Saint of Taint"
You play for a year but then go into the military.
You can't play for a solid year so the account expires...
The name gets dropped from the memory banks on XBOX Live and someone thinks "Hey, Saint of Taint" would be an awesome name. They play under the tag and when you try and renew the account say 1 or 2 years down the road you can't because someone else has it.

Yeah, You cannot get his live gamertag unless he gives you his windows live ID I think but other than that you cannot obtain his gamertag because he has not used it.

I was wondering how long a unused Gamertag will stay unavailable for others to use. There is one in mind that i want and the user hasn't played one game on it nor has signed onto xbox live with it, if its not being used why cant someone else use it???
