I created some desktop wallpapers of Halo 3 ages ago.

Anyway, today I found out that someone had taken my work and started printing T-shirts and selling them on e-bay!

I wouldn't of minded if they atleast kept the watermarks that credited me or 360style (which I made exclusively for). However they did not ask for my permission, and i'm pretty sure profiting from Bungie's or any company's assets is illegal too.

I've emailed them and ebay to try and get it taken down, but had no response :(

1. You didn't make that.
2. If it were illegal to profit of Bungies items, why are there so many Legendary Edition Halo 3's on ebay? As long as you paid for it, you can sell it.

What he's doing is illegal. Not because he copied you,, but because he's making money off of the Halo franchise without MS's permission. If they find out, he's screwed. You should also find some way to contact him and demand some credit on the shirts if he does keep selling them.

@ x S t u n g x
I have the photoshop files, I can prove it down to the last pixel that I created that image. you can see the other version of it on my deviant art gallery.

@ Chibi 27

Yep it's illegal, if you look at the rest of the store they sell loads of t-shirts using various game art so its not just a one off. I emailed their ebay account, their myspace account but had no response. I hope someone in Bungie will help do something about it.

@ xStungx

Your assumption that I could not of made it because your friend had the wallpaper before Halo 3 is wrong.

Follow this link, and look at the post date

i received an email from them.

I'll tell you the same thing I told the last 2 people who also claimed it was their artwork.
We get those full color shirts from a supplier, (we don't have the equiptment to make those shirts) I let them know of the situation and we cancelled the listing. But if you think ebay will do -blam!- about it they wont. We removed the listings out of trying to be cool to the artist. Who ever that might be like I said you'r the 3rd person who "claims" this is your art. None of you own halo and there is nothing any of you can do. But like I said we are trying to be cool to the artists cause we've also been the victom of someone stealing our artwork and we know how it feels.
So thats the end of it.
Thanks

Doesn't sound like he/she cares too much. Bungie are you able to do something about it? I don't know whom the "last 2 people" are?? Maybe from 360style but I'd have to ask.

I am a Floodian

Heh. Someone should ask him who the supplier is, if he doesn't tell you he's lying. No one with good business relations wouldn't say who their supplier is. It would be like someone who loved a certain sushi restaurant not telling their friends the name of the restaurant.

That email was bull. He talked as though he was a business man, yet doesn't capitalize "Halo" and that sentence he uses with "halo" hardly makes sense. He also sounds like a corporate head, considering he uses the word "we" yet doesn't list the company. It's about as vague a denial as you can get.

I Like how he says "None of you own Halo" as if he does. Even if it isn't your art, he is still making money off the Halo name and is breaking some copyright law I think.

Please quickly change the title form all caps before it gets locked.

Double post, sorry.

Strange evolution how people have come to believe
That we are it's greatest achievement
We're barely, we're just a collection of cells
Overrating themselves

Unless the supplier has authority from Bungie and/or Microsoft, they can't sell the shirt or anything with Bungie/Microsoft IP on it.

When Bungie was with MS, they had a team of people looking for people using their IP to make a buck. Since they split, I dont know how robust Bungie's legal team is, so its up in the air as to whether anything will come of this.

This is referring to your particular legal predicament in regards to this t-shirt.

There is a whole other basis for legal issues if Bungie decided to pursue trademark violations against this person and his "supplier".

Thanks for looking up the legal documentation.

Changed the title thanks for the warning Chibi.

Is there a proper Bungie contact or will they come by the forums soon?

Message Achronos. Don't message a mod. They don't work for bungie. :D

Wow, this is annoying isn't it... I know if someone stole my handiwork and tried to make money off it, I would be pretty angry...
That guy who sent you that email sounds like a loser... He doesn't care.
Maybe they should research their products a little more before they go selling them on the internet...
