Today i saw a trailer for a game called "sudden attack". A Korean game similar to counter strike. I went to the website and it plays a video showing some gameplay, I then realized that the song playing in the background, it was the Halo Theme Mjolnir Mix. The video is on the game's english website and can be seen here

Since organized communities are usually more enjoyable, you should take your time to read the forum rules to save yourself some trouble and help keep the forums clean :-)

That doesn't look like it's being used in-game, but just for the purposes of background music in that video. Now, I can't tell from just that video, but as long as it's not used to make a profit of any sort, I'm pretty sure that's OK. That's the same as a YouTube video that has the Halo music set in the background. It's legal as long as they're not making a profit without permission.

However, if they are making money off of it, then there's a problem. I'm sure that someone in the position to take care of this will read over it and do what needs to be done. I don't know all the specifics of the legal system in this case, so I'll leave it up to someone who does.

Why would a professional-looking, all Flash-based* website not want to turn a profit for their product?

*ugh... I hate Flash-based websites... and almost every single one I've ever seen has been for a business website of some sort. This includes halo2.com and halo3.com

I was only going by that one video. It looked to me as if it were just used as background music, but something like that could very well be used to make a profit.

It's not to often that something like this comes up here, (that I've seen at least), but it can result in a lot of trouble when it does.
