On the ODST Field Guide on bungie.net, the Brute's discription says:

BRUTE (Jiralhanae)

Massive and ape-like. Many have been observed speaking human languages. Depending on location and MOS they will be encountered in groups up to eight.

They are fearless, vicious opponents and must not be underestimated. Currently, they fill the command role that Elites occupied previously . Whether or not this is indicative of a power shift within the Covenant is of no consequence to the current operation. ANYTHING that seeks to obstruct the successful completion of your mission is a legitimate target.

This is just a theory, as it may just say this because at this point the elietes were protecting the prophet of regret.

The Prophet of Truth is smart. He wouldn't just use Regret's death as the only excuse.
He would slowly start taking Elites away from powerful positions and put Brutes in their place.
Regret's death was just a nice way to remove the Honor Guards.
(Regardless, Elites are not in ODST.)

Cannon wise at the moment the elites are allies with no one. Think of it as the time as the Elite rebellion against the brutes.even when gravemind captures arbiter and the chief the abriter is still hostile towards John-117.

Wrong. Elites are still allies with the Covenant, Halo 3: ODST takes place before Regret dies. And once Regret dies, Truth decides to push the Elites away.

Remember, Slipspace can take a while to reach certain detonations. Apparently, quite a few days passed by while Master Chief is in Slipspace heading to Delta Halo. Keep in mind that the events happening in Halo 3: ODST take no longer than 2 days. So since Regret doesn't die for quite a few more days, the Elites are still in power and the main enemy.
