Well, I just refunded my copy of ODST for a full $60. I'll keep an eye on this thread cause I want a solution just as much as you guys, but if it doesn't come before the next LIVE update I doubt I'll be purchasing another copy.

Thanks a lot M$, I'll enjoy my $60 that you no longer have.

I'm not arguing that Alpha and Urk haven't done their part, but we haven't heard from Microsoft about a new patch coming anytime soon, and my patience is running thin. Plus, Gamestop refusing to give me a full refund because "it's mine as soon as I opened it" is just icing on the cake of disappointment.

At first I thought I had a open tray issue because the dashboard has been the extent of my odst playing. But then i try'ed the disc on my buddy's xbox, same thing. The disk is in perfect condition and sometimes will read as a dvd and play, the only thing that shows up is xbox 360 logo. I did happen to notice that we both had the BENQ VAD6038 Xbox 360 DVD Drive . So im wondering if the game is having problems with users who just have this drive. To find out what kind of dvd drive you have go to

Theres three different types

Colonel, consumer rights, read up on them and you'll know that you are within your rights to demand a full refund, as you have been sold a faulty product that does not work. Dont let them say it works on other machines, the point is it doesnt work for your one.

Hey all just wanted to add my experience so I received my copy of Halo 3 ODST on the 23rd of September played it that day and then booted it up and it came up with a DRE I checked the disk and noticed some very noticeable scratches so I called amazon and today received a new copy with no scratches after seeing this issue in an article on Gamespy i decided to immediately installed the game to my harddrive and so far no problems.

I am not sure if my issue is the same as some people here since my disk actually looked pretty scratched and did not play on other people's 360's anyway hopefully this gets resolved.

BTW my xbox was manufactured 10/2007.

Thats kind of self contradicting. If what you say is true, then it would the Xbox 360 which is the faulty product, and he would deserve a full refund for that product.

(Thats just what i've concluded from what you said. Sorry if i misinterpreted).

Yes you are very much right with regards to the xbox itself. And it does put this mere 'glitch' into a very tight spot. You could argue the recent update is to blame and could be due for a refund (if they dont fix it, however theyve covered their ass by saying they are 'aware of the issue', not sure on how long they can take before its invalidated.), or you can argue that on select consoles it doesnt work because of some coding on bungies part, in which case, the product is still faulty until fixed.

In that case, they should definitely have an estimation on how long it will take to fix the problem. I would say if they don't set a specific time for a patch to fix the problem, then their statement about "being aware of the issue", is invalidated immediately.
So within a few days you should call microsoft, ask if they have a patch for the xbox to play the game. If not, then you should demand a refund for the Xbox, since it's obviously the faulty product and not the game. At the least, that should get you some answers on when you can expect a fix.

(I know nothing about consumer rights but this is just my opinion)

You guys are all correct. We were all sold a defective product. All the issues lumped together are an epidemic and Microsoft should take steps to make their customers happy.

On a side note - I tried the "boiling method" and it actually worked. I heated a bowl of water in the microwave for about 2 minutes. I submerged the disc in the water for about a minute, dried it off and like magic, it worked! I have no idea what this means but, I figured I had nothing to lose by gambling with this method. I'm just happy to have a playable game.

Firstly, i dont condone the boiling of discs, as it throws your rights out the window when you go to return the disc. But congrats on getting it to work! :)

Secondly, we still need more info on what is causing this issue before we can point the finger, wether its shoddy coding on Microsoft's part, or Bungies. Or again, it could just be a bad disc. Time will tell.

(Disclaimer: I am not player hating on either company, im just merely explaining the situation as how 'I' see it)

EDIT: JAK33: Im not paying MS to get a replacement machine for the other one they've (maybe) broken.

Well for this with questions about product liability here is a great link I found http://www.joystiq.com/2009/09/29/lgj-products-liabilodst/

That being said my local retailer was ok with returning my faulty game after my third time of returning it. I got GH5 instead. So, um..... rock on.
