It's actually against your legal rights for Bungie to ban you for speaking of leaked material as it's Bungie's lack of security which caused the issue, but the legal team at Bungie isn't skilled enough to keep this company outta legal woes. Look so as a law student with a 4.0 GPA (wink wink)if any American company provides a forum to speak then in terms it is illegal to censor your speech weather it be written or verbal, unless it becomes disruptive to the forum which this obviously hasn't as people are still posting topics. The right to freedom of speech is recognized as a human right under Article 19 of the Universal Declaration of Human Rights and recognized in international human rights law in the International Covenant on Civil and Political Rights (ICCPR). If you do get banned then I would take it up with the ACLU or any competent lawyer which, in turn, would probably start up a class action lawsuit under the First Amendment. Bungie would lose this one easy in a court. All the rules of this forum do is give them a reason but the courts will find that the reason given actually infringes on your rights and rule in favor of freedom of speech. They ALWAYS DO as an example a man was on trial for threatening to kill the President (verbally) a few months back he has now been acquitted under the First Amendment. Have fun banning Bungie cause if you Ban me you will find your self in court guaranteed.
This is the Internet, those rights really don't count here. There is a rule in this, and other, forums saying posting leaked content real or fake will result in a ban. Get it? The websites RULES state that.
But if my freedom of speech is a huge issue, let me offer some examples.
The public pool says they have a right to kick you out. Now, if I start shouting racial slurs and they kick me out, can I sue them? I mean, I was using my freedom of speech.
Or if I shout "FIRE!" in a crowded theater. You aren't allowed to do that, but could I avoid jail time by claiming I was using my first amendment rights?
Please, taking Bunie to court over them banning someone from their forums because they broke the rules would never get past any judge. Hell, one PSN user was banned for violating the rules and he sued Sony. Guess what? The judge threw out the case.
Basically, you're full of -blam!-.
