The second issue you pointed out is a non-issue with the game going offline. The ONLY games being played now are on private servers and locally at lanparties.
As for the first issue, you can probably rig a video DVD as a frontend for installing content to a console very easily, as the 360 is quite okay with opening those, and it's something I've seen done before with pirate versions of DLC. But even then - authenticating an original XBox DVD shouldn't be an issue as it's not like they need to worry about piracy for the original XBox these days, is it? Just make a bootable disc and the content it installs will be recognised fine.
Claiming that "if people really wanted the maps that bad, they'd have used the 3+ years after Halo 3's release to get them" shows you don't understand the actual issue, my reason for this is more that as time goes on more and more people will lose these maps (Due to RRODs requiring console replacement, etc) and be unable to replace them. In the end only users of modded consoles with backups on their PC will be able to use the maps. End result - hackers/pirates win, the rest of us custmers lose, as with every situation.
As soon as I get my hands on one of those nice little Datel devices I'll try to put together a little proof of concept, though without any right to distribute it, I doubt I'd be able to seed a torrent of it like Bungie could.

Or hell, Bungie could give us a stripped down H2 content download frontend that'd work over VPNs, but that'd be a lot more work.
