Actually, Blizzard was sued by a British company called Games Workshop over copyright infringement in Starcraft. Games Workshop (GW) said that there were too many similarities between Starcraft and it's Warhammer 40,000 game. Partly true, sicne Starcraft had been developed as a Warhammer 40,000 game but had to be switched to what we all know at almost the last minute because they were unable to get the liscense. A countersuit followed when GW kind of got a shot in at Blizzard in theri designs for the 3rd version of teh Tyranid race in Warhammer 40,000. Both cases were thrown out of court, as I recall.
As to Halo, it's msotly original. Stuff like the Marines and the Master Chief remind me of Starshipt Troopers, but considering that Starship Troopers is to sci-fi what Lord of the Rings is to fantasy, I can't complain at all there. Never seen anything like the Covenant (unless you count Star Trek's Dominion), thoguh the Flood seemed uncharacteristically cookie-cutter (Aliens, the Borg, etc.).
