Rather than allowing people to justify using a mod in MM or not. Simply create a match that is for modders only. Then if any modder that appears in the non-modding playlist, simply ban their IP entirely. Your conscience would be clear. You gave the people who for what ever reason like to cheat an out, and they CHOOSE not to take. Decision made, thank you for playing Halo 2, you are no longer welcome.
I understand that Bungie/MS/XBoxlive are trying to deter modding and your efforts are warranted. But unfortunately Mod culture is here and has been back since Doom on the PC. People like altering the reality of a quality product, you are not ever going to end it. But if you give modders and out and the don't take it, they can not argue your decision to ban them.
I hate modding and stand-bying as much as the next person, hell when I see it happening on a team that I get paired up with, I attack my own team and let the other team know that I am helping them. It actually worked two days ago, the people stand-bying actually quit and the non-cheating team won. I digress....
End of the day Halo 2 is a great product/game, and I appreciate the efforts bungie is going to to make it better for the 90% of the players that truly just want a good game experience. But I do think a justified hard line is necessary. Read any of the post of people supporting modding and you can tell by the general lack of spelling that you are dealing with a 8 - 12 year old, you send a letter to their parents making THEM aware that the account they bought for their child is being banned for illegally altering their gaming system AS WELL AS altering the online experience for other users by cheating and I'm sure things will change.

I do that sometimes too. I don't like losing my level, but I don't like modders either.
