Lawsuits toward Bunnycrusher will be the last thing on Bungie's mind. They've got enough pirates to go after to keep them busy for the rest of the decade. Besides, copyright laws are there so that people don't make money unfairly from material that someone else created.
Bunnycrusher doesn't need permission to make his movie, even if he sells it. There would be such a tiny audience for his film that it would be almost impossible for Bungie to even catch wind of it. Even if they did, it isn't a major commercial venture designed to exploit Halo for the purpose of monetary gain. It just isn't something he needs to worry about.
Assuming a worst-case scenario (Bungie and Microsoft find out, his movie sells like crazy, and Bungie and Microsoft feel like being evil,) the worst that would likely happen would be Microsoft issuing him a "Cease and Decist" order, meaning that if he stops selling it, there will be no legal reprecussions.
So he ain't in any danger. ;)
