Subject: Halo fan games, legal question

if some one wants to make a fan game, with halo content in it for example the unsc and covenant, what are the legal requirements,

so for example, if some one wanted to make a free game that has some of halos IP in it, made it free, put the Microsoft and bungie logo, and clearly states that the content exclusively remains property of Bungie and Microsoft would that be ok

so like if someone wanted to make a crossover fan game like

halo vs star trek

halo vs stargate

halo vs star wars

ect ect.

what are the legal requirements thanks :)

DISCLAIMER: I am not a legal expert and any opinion is pure speculation.

As long as you don't profit from it it will probably count as fan-fiction. That said, creating a video game may be new territory and could cause you some problems.

This should help.

i really do hope so, i intend no copyright infringement and would love to be welcomed with open arms in creating this game, as it will be quite great,

and giving it away freely with bungie's permission

As far as Halo goes you don't need Bungie's permission, you need Microsoft's. That said, if you are only making a fan fiction flash game you shouldn't have too much trouble.

its an RTS made in game maker with a complex design

What I meant by that is if it is only a game on the internet that you aren't making any money off of then you should be left alone.

Just to be on the safe side you might want to email 343 or Microsoft to avoid getting a cease and desist order.

  • 04.13.2011 8:01 PM PDT

  • 04.13.2011 8:02 PM PDT

If you worry about the copyrights thing, as long as you don't make any kind of profit from it, you're free to do whatever you want. But if you want to use this as some kind of CV you could post it and promote it on Halowaypoint forums.

  • 04.13.2011 9:30 PM PDT

thats good, i never wanted to sell this any way :), hmmm yeah i might post it on there also :)

It takes a real man to back down from a fight, but it takes a spartan to finish it!

Feet First Into Hell.
ODST General since Halo 2
Xbox Live status - Repaired

www.judgegame.com

Generally they don't care about free games or movies, they have the content usage thing which is good to read and acknowledge. Contacting them for permission or at least to let them know through their PR department or something is likely your best move.

Generally they don't care, chances are the worst they will do is tell you to shut it down. Halogen being the best point for that case.

yea but halogen was comming out when they were making a halo rts, i guess they fought it would cut into there profits and EA games would make a profit as it was being built on there engine

however mine is a stand alone game made on my own engine and i also doubt an official star wars vs halo game will be released any time soon lol.

@ pwnisouras: im really glad you liked my work, pretty soon ill be working on the long hard dreaded ground battles of this game, oh god this is gonna be a challenge all right lol

The Razor.

For the honour of the Mirratord.

As long as the game was non-profit, it should be okay. Halo Zero was released a while ago, and I don't remember any backlash from Microsoft.

However, if you do require legal permission and you were doing a crossover game, you would need permission from the owners of both franchises. So, for example, if you wanted to make Halo vs Stargate video game, you would need permission from both Microsoft (who own Halo) and MGM (who own Stargate).
