Look, you can do this on eBay. I don't think there's a copyright on the blue flaming helmet; it's fair game.
Just because you think it's morally wrong doesn't mean it's wrong in a legal sense.
They're pulling someone in to buy something that they can get for free, it definitely falls under the 'scam' category for me. He's preying on the people who don't know they can get it for free, without putting the information that people can get it for free without giving their information to some guy on the internet.It is a scam and it is a violation of the TOS for ebay for being a scam.
People cannot get the idea that they can sell free stuff for a price when its not theirs to sell in the first place.
You clearly haven't been on eBay much; go search OpenOffice. It's an open-source MS Office clone that you could get for free. You'll find that it's all over eBay, being sold on discs for a decent amount of money. They're not being reported or taken down; they're not violating eBay as the item isn't under copyright.
Like I said, it's shady, but not a scam.Solid objects is different then digital.
This is about something you will have to come here to activate. In the end, Bungie owns the flame and is giving it away and not some jester ebay player. The violation here is that the object in question is not his to sell. He cannot sell items that are not in his possession.
