Almost all items on eBay are sold like that unless it's from a store usually. But for this, it sounds like the seller is going to empty the bag of the most valuable items before he/she ships it. I really don't trust people on eBay after I paid $50 for a game and I got a fake copy. \
Well he mentioned in the listing that the bag itself was unopened and he has no idea of the content. One could assume he plans to sell it all as is. In the unfortunate event that he does decide to empty the bag and go "ha-ha" the buyer can file a dispute, get their money back and the seller will be warned and or banned.
As for you, your case is a little different but I would have still suggested filing a dispute to get your money back if you did not. Copies and counterfeit items are also against policy and are strictly enforced when sufficient evidence is found.
If for some reason you lost a dispute case for the item in question then I apologize, there are some real jerks behind the keyboard.
