Games can have common gameplay or a common idea, but still be rather original, maybe not completely originally, but not a total ripoff. I mean if that were the case, then Marathon would have been a rip-off of doom, Call of Duty ripped-off Medal of Honor, and Heros of Newerth ripped off DotA.
I would not consider any of the games I compared to be completely the same, and brings different game mechanics to each of it's genres, but not a complete rip off of the game.
Obviously, someone would be lying if they claimed that Crimson: Steam Pirates was the first pirate ship fighting game to ever be created. The same would actually go for Pirates of the Caribbeans. The first game I remember playing that had pirate ship fighting game mechanics would be Corsairs: Conquest at Sea, which definitely came before both games.
But I still agree with you somewhat. Yes this isn't a totally original idea of pirates fighting on ships against other ships, it's been done before. But if you look at it that way, you can consider that every modern military shooter has been just a constant rip off of the original Rainbow Six.
I would not consider Crimson a ripoff, I think it offers game mechanics that have not been done before. And does it in a way that is really fun to play. It definitely has some features in the game that I've never seen done before, such as weapon hotspots, special abilities with certain crew member, boarding ships with a crew members and weighted fights depending on chance, and throwing in some flight combat and submarine combat.
Marathon would never qualify as a rip-off of Doom. Terminals, dual wielding weapons, fluids to swim in (or die in), and actual story, better music, cool physics (flying backwards when shooting the Spnkr, grenade jumping), a manual that actually tells you something, much more modability ( i.e shapes files, physics files), interesting map names, terrific lighting, interesting enemies who aren't just ammo-sponges (except for MoAH), powerups, allied ai who assist you actively, real objectives (like protecting the BoBs), enemy weaknesses (robots get hurt much more by the fusion pistol).
Then you have the enormous mythos surrounding it that started with PiD. I mean, what other FPS at the time had a story as convoluted as Infinity's?
Marathon falls into a completely different category than Doom.
