If we have Terms of Use?

The ToU seems to cover everything important and in good detail.
Are the rules and CoC just complicating the moderating process?

  • 11.09.2011 7:16 AM PDT

The terms of use deals with the legal issues of having forums and a website.

The CoC deals with how users should, in general, behave and what to do on the site.

The rules deal with more specific cases of bad things users can do in the public forums (dealing only with the forums rather than the rest of the site too).

There are many powers in the world, for good or for evil. Some are greater than I am. Against some I have not yet been measured. But my time is coming.

The forum rules are derived from the ToU and CoC. I think of them as a tl;dr version. Why there is a CoC and a ToU, beats me.

My initial response was going to be "to keep the peace" but now...

The CoC looks like it's derived from the ToU, and the rules from the CoC...

Why not just use the ToU as the guide?

The whole forum rules could be summed up with:

you will not:

Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.
Restrict or inhibit any other user from using and enjoying the Communication Services.
Violate any applicable laws or regulations.

Also, the rules may have been rewritten, but people are still being banned and warned as if the old version was still up.

I'm guessing It's all within legal reasoning.

There really aren't a lot of things that were against the old rules and are ok now. More often than not, this is really a language issue in explaining the ban or warning. Of course ninjas are people and people make mistakes and old habits die hard.

The forum rules are not an all encompassing legal contract. The Terms of Use are.

Wow, you're back!

But seriously, this.

The rules are a shortened, easier article to read, the Terms of Use is the red tape/complicated part. (so to speak)

I could guarantee that the majority of the users who visit this site never read or even bothered to read the ToU. I never did.

It is the soldier, not the reporter, who has given us freedom of the press. It is the soldier, not the poet, who has given us freedom of speech. It is the soldier, not the campus organizer, who has given us the freedom to demonstrate. It is the soldier, not the lawyer, who has given us the right to a fair trial. And it is the soldier who salutes the flag, who serves the flag, whose coffin is draped in the flag that allows the protester to burn the flag.Father Dennis Edward O'Brien, USMC

So the Ninjas can have somhing to make them feel important. Without rules they would perhaps be useless in life.

Nah, more likely than not the job position just would not have been created.

People that aren't old/smart enough to read and understand the Terms of Use shouldn't be allowed to post on the forums in the first place.
