Make sure your settings aren't muted, do you actually see people with mics? Or do you just never hear them talk.
If you are actually mute banned, either yourself, or your mic is at fault. There is a weighting system in place, so people who mute a-lot do not count very much towards a mute ban. That means that enough individual players (who don't have a tendency to mute very often) muted you. Keep in mind, it wouldn't just be a few games this happened in, it would be if you are doing something almost every time you played for a length of time. Or maybe arena or mlg, I hear everyone mutes people with mics in those.
The most common causes are you being annoyingly loud and obnoxious, being a screaming 'squeaker', playing music through the mic, or trash-talking. Or, it could be your mic if you are using a kinect mic (which echos and sounds like you are in a fish tank), or it causes buzzing or screeching noises.
While Bungie may have created the system, no one at Microsoft should have told you to take it up with them, as they do not run Halo any more. A subsidiary of Microsoft's gaming division (343 Industries) is in control of that, it is them you would have to have rescind any type of ban.
