It's cool. I'm about to go read the details of OPEN and I'll edit this post in a bit with a response.

What's to define if a website is DEDICATED to infringing activity? YouTube is dedicated to the upload of videos. Uploading SOME videos is infringing activity. So is YouTube dedicated to infringing activity, if only in a minor way?

(3) CONSULTATIONS. In conducting an investigation initiated under paragraph (1), the Commission shall consult with, and seek advice and information from, the Attorney General, the Secretary of State, the Secretary of Homeland Security, the Secretary of Commerce, the Intellectual Property Enforcement Coordinator, the United States Trade Representative, and such other officials as the Commission considers appropriate

Really? The Commission is going to consult with the Attorney General, the Secretary of State, the Secretary of Homeland Security, the Secretary of Commerce, the Secretary of Commerce, and the Intellectual Property Enforcement Coordinator for EVERY SINGLE review and investigation performed? That would take way to long and nothing would get done! Not that I want anything to get done but the above people would basically have to live and work at the home-base of the Commission (wherever it is) to handle all of the issues submitted for review!

What does the Bungie Community think of OPEN (Online Protection and Enforcement of Digital Trade ACT)?

It is a compromise bill of SOPA that eliminates a lot of the fuzzy language.

Immunity for taking voluntary action is left over from the original bill, and seems a bit strange to me. For all the amount of due process they add, it is still perfectly legal for businesses to try to shut each other down outside of court procedure.
And while this bill does seem to do away with filtering search results and taking over the DNS system, it still puts the entire burden of enforcement on US financial and advertising companies. Because I am not affected by this, I care much less, but I don't see how punishing US companies that happen to be tangentially related to the offenders with the burden of carrying out the government's will is fair.

We are trying to legislate outside of our jurisdiction, and it just places burden on law-abiding US citizens and companies to try to deal with it, rather than target the offenders directly.

If other countries don't respect intellectual property, that sucks, but you shouldn't go punishing Americans to try to teach them a lesson. I say scrap the whole bad idea and work on diplomatic ways to get those countries to beef up their copyright enforcement.

smart, interesting, seems out of place.


Official fan of Assassin's Creed, Call of Duty, (Problem with that?) Halo, and Bungie, also a total gaming junkie.

If this affects Microsoft's, Activision's, and EA's income in a very negative way, then I can pretty much guarantee that this thing waas doomed they day it was thought of.
