From what I've noticed, I think it depends on how many times they betray. Bungie obviously wouldn't give people the option to kick people who ACCIDENTALLY betrayed them only ONCE.
In one game someone betrayed me for the Needle Rifle on Boneyard. I didn't have the option to kick him, but right after he betrayed someone else, and then it gave me the option.
I have actually been booted for entirely accidental single betrayals while getting betrayed repeatedly by teammates with no boot option. In my experience, there is no rhyme or reason to getting an option, which I find incredibly frustrating; mostly because I make it a point NOT to attempt to team-kill, even when a random is trying to grief me. I think it's poor taste, and I won't do it on purpose, but teammates will jump at the opportunity to kick me out of the game.
Basically, my personal experience suggests that the system is effectively random, and karma doesn't count for anything anymore.
