No. From what others in this thread have told me, it won't matter if I clone the hard drive. Please don't tell me that's wrong...
I've never clones a hard drive, so I don't know, but some people report OS instability if they switch motherboards that are different brands. A lot of people suggest uninstalling the old drivers before doing this, although you'll have to remember that the built-in network adapter runs from a driver, so if you fail, be sure to have a backup disc.

So it will be all good if I just uninstall the motherboard's drivers? Or the network adapter's drivers?

You could be perfectly fine without uninstalling any drivers, but you never know what could happen. You'll have to wipe the drive to install W8 anyway, so that should solve that issue.

Well if I were in your situation, I'd nab a 32GB usb drive, backup all of my documents, videos, and pictures, and perform a clean install after I had my build put together.

I think you have to buy an actual disk for the OEM version. The OEM version is meant for people building their computer, so it doesn't make sense you would have to download the OEM version.

I didn't realize you were building a new computer when I made the suggestion to clone your hard drive, my apologies. I only read the part about you getting a new 1TB drive. The cloned drive could give you compatibility issues when it wakes up and finds the new hardware, but Windows Update will likely find the new drivers for you. Personally, I'd just wait until you build your new computer to install Windows 8 to avoid such issues.

No, that is the upgrade version. You can do fresh installs from it, however, if it's like past versions of Windows. The OEM version is only sold at other retailers (Amazon, Newegg, etc.); you cannot buy it directly from Microsoft.

EDIT: I wonder if it's possible to transfer the OS from the 400GB to the 1TB without cloning, then? That would make it easier.

You're technically correct, but if you put it on a thumb drive, and make it bootable, you can use it for fresh installs. This is probably against the EULA, however.

Ok. Imagine me upgrading to windows 8 on my 400GB drive. Could I theoretically transfer, not copy, the OS to the 1TB hard drive? Because then it would still be the same copy and an upgrade, but just on a larger hard drive.

You're not paying for Windows 8, per se, but rather the privilege to use it (activation key). If you want to move your copy of Windows to another machine (or hard drive), you would have to first remove it from the current one. You can do this a few ways, but the most common is to just reformat the drive. You can only (legally) have one install per key at a time. With the OEM copy, you are not allowed to move the install to different machines - it's bound to the first machine it is installed on.

edit: The only reason cloning doesn't violate the EULA is because you aren't using the same install on two different machines simultaneously. Most people just use clones as a way to transfer their system, or as a way to keep a backup of their data.

So I could get a thumbdrive, put windows 8 or an image of it on there, wipe the 400GB, and then boot with the thumb drive? I'm sorry, but this is all so confusing >_<

Once you get the image from Microsoft, you can use this to create a Windows 8 install disk (USB) or disc (DVD). Installing from a USB drive would just be much, much faster.

Why can't he just get Microsoft's official .ISO file for Windows XP, install that to his new HDD, take the key from the old computer and use it with the new (assuming he has a prebuilt which allows the key to be moved), and then use the W8 upgrade?

Yes I have a prebuilt. I guess the key is under the properties of "My Computer"? It has OEM in it, right?

Doesn't matter, I'll never need XP again unless -blam!- hits the fan and all of the files go corrupt during windows 8 installation.

EDIT: Oh are you saying that if I follow fluffies method, there will be remnants of XP? Does that matter?
