Apparantly you're just throwing irrelevant material around, such as the reconstruction acts. It was just a process to get the rebel states back into the union. How does that have anything to do with what we're talking about?


You know why the Reconstruction Act was passed, right? The Southern states initially were refusing to ratify the 14th Amendment after the civil war. Because of this, they effectively went in and removed the power of the state government; which was voted in by the people.

Because you seem to have trouble drawing simple conclusions, I'll spell this out for you. This, in effect, sets a precedence for the Federal government to ignore the wishes of the people if it impedes on the overall rights of the American people. Again, we go back to the Founding Father's fear of a mobocracy ruling America.

They draw this power from the political philosopher, John Locke. In his definition of the relationship between government and people, he says the government and people are entered into a social contract. According to this social contract, the people trade in some of their rights in order to order for security of rights. The government is obligated by their half of the social contract to protect the rights of their people above all else. Sometimes, this involves superseding what the majority wants.

Boom! Lawyer'd.

Who even told you that? If an amendment passes both houses of Congress AND the states, no one can stop it from being added to the constitution.

In addition, if the government declines the wishes of the people, all the people have to do is to wait for the term of their representatives to expire and then vote in someone who represents their ideals.

The people are complaining because the constitution says the government isn't supposed to show religious bias. They have every right to challenge trees being placed by the government.

People in the government do, but the government itself (the laws) does not, or is definitely not supposed to. Can you point to legislation that shows favoritism? I'm not saying it doesn't exist (there are plenty of nonsense state laws still on the books), but they shouldn't be there (or enforced).

The issues is usually about who is paying for it. People are more than welcome to celebrate whatever they want, but it does become an issue when government starts paying tax dollars for a religious celebration that means nothing to any citizen that isn't that religion.

True, but since it's such a HUGE celebration and holiday, I think an exception should rightly be made. We're talking about something the overwhelming majority of the country celebrates and/or reaps the benefits from (time off work, presents, whatever).

The only people who have a legit complaint are those who, for all intents and purposes, live their life as they do any other day on the 24th and 25th.

I think anyone that believes government should be secular has a legitimate complaint if taxpayer money is being used for religious rituals.

Plus, that's how society works, the majority of people, with the same beliefs are going to have majority say. If you live in America, you should know that the majority of the population is Christian, thus, they will celebrate christian holidays.

This has been said several times in here. Unfortunately, It isn't true. "Unaffiliated" is actually the largest religion in America today.

I live in a country where Christianity isn't the dominant religion but in malls, they put up Christmas trees and other decorations. I don't mind it the slightest bit.

I don't find a tree and pretty decorations offensive.

I think it's a good thing to get in the habit of saying "Happy Holidays" to others during this time of year, but I think it's kind of ridiculous to be offended by a Christmas tree. If it bothers someone so much, then they just shouldn't go to that place.

I assume the mall is privately owned space and your tax dollars did not fund the tree, workers that decorate it, or decorate the rest of the mall. I don't think anyone is offended by the sight of the tree, is government endorsing a specific religion with you tax dollars that irks people.
