only idiots would actually advocate death in such a scenario, however, jail time should not be taken out of the equation. Just because someone is a child and cannot fully comprehend empathy or consequences, does not mean consequences should be abolished.
It honestly depends on the extent. If the person they're bullying has attempted (I don't mean had thoughts, I mean has attempted) suicide or has already committed suicide because of their bullying, then jail time should be a serious consideration.
That's a completely unrelated issue which is actually in law. It's somewhat bogus, honestly. If the bully's actions can be proven to intend for his target to cause self harm, then he can be held accountable for said self harm. If the bully was being an -blam!-, he can only be held accountable for being an -blam!-.
It's a parallel I somewhat draw to sports. If you commit a penalty, the penalty should be assessed based on intent, not on result. i.e. if it's a dirty hit and a player gets hurt, they should be penalized. If it's a malicious hit and the player does not get hurt, the player should be suspended REGARDLESS, if it's a clean hit and the player is hurt, there should be no penalty.
