Gun-rights advocates claimed a major victory on Tuesday when a federal appeals court in Illinois struck down the state's ban on carrying concealed firearms, in a ruling that may have national repercussions if appealed to the U.S. Supreme Court.

Before the 2-1 ruling, Illinois stood as the last state in the country maintaining an absolute prohibition on the carrying of concealed firearms by private citizens. The majority opinion, by Richard A. Posner of the Seventh Circuit Court of Appeals, found the ban on concealed weapons was unconstitutional under a 2008 Supreme Court decision overturning a sweeping handgun ban by the District of Columbia.

The Supreme Court's decision in 2008 firmly established a constitutional right to armed self-defense under the Second Amendment, Posner wrote.

"A right to bear arms thus implies a right to carry a loaded gun outside the home," he wrote.


I'm kind of surprised at this. I don't think that the second Amendment is written broadly enough so that concealed handguns would be protected by it. Not allowing CCW permits to be held by private citizens does not ban guns or prevent someone from owning one, it simply restricts what can be done with it. There are many restrictions on when guns can be shown or fired, I don't see why that wouldn't apply to when they can be carried too.

CCW can work both ways. A criminal can walk into a store and hold it up without anyone knowing. On the other side, if a person had his gun out in the open and he happened to be at the bank with a criminal, the criminal will either kill him first or disarm him. The gun he has concealed can possibly save his or others' lives.

I think a lot more people are comfortable walking around with a concealed sidearm instead of letting all who look at them see that they are carrying it.

This is also a good prevention for criminals to attack people if they can't tell if someone is carrying a sidearm or not. This doesn't mean that it will stop people from attacking others, but it will surely help.

Modern Translation: The Right hold weapons.

I think the Second Amendment was broad enough for that. Showing and firing guns is much different then carrying one concealed.

This makes me happy. With more responsible, trained citizens carrying, criminals will be less inclined to do stupid things. Now, if only everyone was a responsible, trained citizen...

That's wrong for several reasons. First being that criminals ignore CCW regulations/laws because they're well, criminals. Merely saying 'don't do it' obviously has no effect on them. Furthermore, a law abiding person wouldn't take a CCW into a bank, hospital, school, or other 'gun-free' zone.

Right to hold, or right to own?

I think people should be able to carry guns concealed in their homes or places of business. In other places, it should be left to the professionals.

I probably used force poorly.
Anywho, the intimidation of a gun being displayed cuts both ways in terms of effectiveness.

It may deter potential attacks.
But when all guns are publicly displayed, that means a criminal can know when or when not to attack. With concealed weapons, they would not know who is armed and who is not. Meaning they cannot plan accordingly.

Criminals cannot get permits for CC. depending on the local CLEO, someone who never did anything worse than a parking ticket could get disqualified.

CCW=legal law abiding citizens.
