Gun-rights advocates claimed a major victory on Tuesday when a federal appeals court in Illinois struck down the state's ban on carrying concealed firearms, in a ruling that may have national repercussions if appealed to the U.S. Supreme Court.

Before the 2-1 ruling, Illinois stood as the last state in the country maintaining an absolute prohibition on the carrying of concealed firearms by private citizens. The majority opinion, by Richard A. Posner of the Seventh Circuit Court of Appeals, found the ban on concealed weapons was unconstitutional under a 2008 Supreme Court decision overturning a sweeping handgun ban by the District of Columbia.

The Supreme Court's decision in 2008 firmly established a constitutional right to armed self-defense under the Second Amendment, Posner wrote.

"A right to bear arms thus implies a right to carry a loaded gun outside the home," he wrote.


I'm kind of surprised at this. I don't think that the second Amendment is written broadly enough so that concealed handguns would be protected by it. Not allowing CCW permits to be held by private citizens does not ban guns or prevent someone from owning one, it simply restricts what can be done with it. There are many restrictions on when guns can be shown or fired, I don't see why that wouldn't apply to when they can be carried too.
because the Heller decision specifically mentioned protecting the right to self defense, which doesn't only apply to being in your home. it also applies in your car/vehicle and your place of business.


also you should thank the nra for it being partial incorporation(being left up to states). SAF was arguing a similar case that would have argued for full incorporation, leading to most gun control laws being overturned.

I am a proud holder of a Conceal Carry license in Texas. SO I like this news obviously. I just wonder if they would ever consider making a NATIONAL license for Conceal Carry. Because you have to be registered for this in every state individually that allows it.

Because I don't use it for that purpose..? I use them for target shooting, which is a very fun hobby. I also find them very interesting mechanically. The way the parts work together is fascinating. It's also like looking through time when you look how materials and designs evolved over time.

And in the unlikely chance that I ever would need to defend myself or others, guns give me the means to preserve life. I hope I never have to, but knowing that you have the means and capability of defending yourself and the ones you love, or even total strangers, is comforting.

That is a pretty hasty and uneducated generalization my friend. I am a gun owner and I carry one on me where ever I go that is legal for me to do so. I am TRAINED to only use this weapon in DEFENSE IN A LAST RESORT. I am not going to clinch my grip at hind site of potential trouble. Gun Safety is a must for ALL owners, as well as the proper training in usage. People need to be disciplined in this mater when handling one. Because if you are not, there are some very obvious yet serious consequences.

Also since people are wanting more and more laws that restrict us gun owners--they are wanting to reduce the chance of criminals getting their hands on them. Good intentions they have yes, but lets face it. Criminals are criminals. They do NOT care for the law, so they will do it anyway.

Another thing. If the past is the be any lesson. Lets look at the times of Prohibition. The ban of Alcohol sparked a MASSIVE bootlegging operations everywhere. There was more violence and the criminal world grew big time. If there were more laws on firearms here in the US, would the same thing happen then? Cause and effect. "Those who do not remember the past, are condemned to repeat it."

Do you know what the Second Amendment actually says? If so then this should not be a mystery.


A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

There's no question that this doesn't keep the government from placing any restrictions on guns.

I have freedom of speech, but that doesn't mean I can yell into a bullhorn in the middle of the street at 2 in the morning. Just like I can have a gun, but that doesn't necessarily give me the right to conceal it and carry it at all times.

Well as long as the proper precautions are in place...which they are, anyone here with their CWP can attest to it. It does take some time and a thorough background check is done in order to get your CWP.

And yes there are many restrictions on when and where you can carry. Most businesses if you look at the front door will sometimes have a "no weapons" sign. Malls are off limits, schools, etc. It's at the discretion of a landlord/manager whether they are to be aloud in their establishment.

Glad to hear this, I don't get the logic in banning concealed carry anyways. It's not like a criminal is gonna be like "Oh, it's illegal to carry a concealed weapon? I guess I should obey the law and wear it openly THEN break the law and rob/shoot someone".

Very true, however people who do that usually are unstable to begin with. Also, case households more commonly contained an illicit-drug user, a person with prior arrests, or someone who had been hit or hurt in a fight in the home.
These people in the study obviously had backgrounds already, the majority of gun owners do not run around and shoot people.
