Sure - but generally if you actually engage in a legal tussle, you're going to need some proof of when you came up with the idea.
Which is why official registration with the US copyright office is a good idea.Yes, but it's illegal to require formal registration; once a work is "published" it is automatically copyrighted by the author.
Regardless, business and product names aren't something you can copyright; this falls under trademark law.
