I believe they can.No, don't be ridiculous. Just because someone on the Internet discovered that their poses are familiar, doesn't mean they can sue the artists. There is really not enough that identifies them as a private person.
The artist just took these pictures as inspiration/pattern and redrew it. A lot of artists do so. People are just overreacting on this... again.
It is mostly because Hammerpoint yet again cuts corners, sloppy, lazy, arrogant. No... it's just the artist doing his work. This has nothing to do with the developer itself.
See, when you are doing this digital art, it could happen that you draw something entirely new. You need a reference. And when you are not such an experienced artist or there is no time, you simply redraw something. Unprofessional, but not illegal or worth raging about. It's not like these examples are some official, licensed posters from the Walking Dead either. Just pictures from the set or cosplayers.There is a line between reference and plagiarism. No one expected them to make a completely novel concept of a zombie, but then again no one expected them to take pre-existing media and mirror it or make only the most superficial alterations.
