not all cheesecake has a crust.

it's just creamy cheesey stuff on top of crushed biscuits.
i wouldn't call that either a cake or a pie; i'd call it a dessert.

imo a crust is either around the sides or on the top.

Well it has a crust, so it could be a pie, but it usually isn't made out of some sort of fruit, so it could be a cake.

It is a hybrid breed of pastry.
