Well, here we are. I guess that it was destined to come to this.
The issue was that he/she are both married to other people and working together.
If she had decided "I am going to quit the job because this is too much of a risk for my marriage", she would have been within her rights and this wouldn't be a story.
She didn't sue for sex harassment, because the flirting was mutual, and she was being honest about it. It was two adults who liked each other being adults. Not professional, not wise, but that sort of thing happens all of the time.
Was she really entitled to unlimited employment until SHE decided that she didn't want the job anymore?
My view is that employment (when there is no contract, if there is, the terms of the contract apply) is a mutually agreed upon situation by both sides and either side can "end it" whenever they choose. I could get a call tomorrow from my boss, and (lacking a contract) could be told "don't bother coming in ever again". If I was 6 that wouldn't "seem fair", but I am an adult and I understand my position and situation. No one owes me my job, no one is obligated to employ me, I am employed because they want my services and are willing to pay for them.
