Rhetorical question: It doesn't.
If there's an on going problem you take it step by step through appropriate channels to have the conflict resolved. Dog gets in your yard, talk to the owner, dog still gets in your yard, if owner refuses to comply, talk to the city, etc.
You don't jump straight to shooting the animal. Hell shooting the animal isn't even on the table unless the animal was threatening the guy.
Again this goes back to the lack of background information on the situation. For all you know he could have complained to police multiple times about this issue and it was never resolved. Either way you can argue for both sides with the given information since it is so broad and lacks a lot of details.
