How a man convicted of manslaughter and sentenced to 17 years in jail for beating his grandmother to death with a hammer and out on parole managed to get a handgun, shotgun and a semi-auto rifle?

I think I know the answer: The ATF is hamstrung, muzzled, and lacking not only teeth but bite in even doing the basic job of making sure that violent/mentally ill people don't get guns thanks in part to the NRA, it's money and it's lobbying, fear mongering politicians and blind delusional paranoids all spinning the story to the greater populace about how the GOVMENT GUNNA TAKE UR GUNZ!!!!

It's clear to me that the NRA is a toxic organization whose interests do not serve the best interests of the USA, nor even those of their own members.

Well, here we are. I guess that it was destined to come to this.

You do know that for a convicted felon to even hold one of those is a crime, right? So when he even attempted to get them, he was ignoring/breaking a law. When he set fire to his house, he was ignoring/breaking another law. When he opened fire on the first responders, he was... yes indeed, ignoring/breaking plenty of other laws. All serious laws and each one intended to make people safer, more protected and secure.

Why didn't any of those laws stop him? Oh wait, I know! Let's make one MORE law to make it a crime and THAT will stop people like him.

I agree with the statement that there's too much legal bloat in our governments.

Right now I'm of the opinion that the Supreme Court should be reviewing the case where they declared the creation of a national background check system as part of the Brady Law unconstitutional. Right not it's voluntary and apparently the government will approve a sale even if they are missing chunks of info.[url=http://www.nytimes.com/2012/12/21/us/gaps-in-fbi-da ta-undercut-background-checks-for-guns.html?pagewanted=all&am p;_r=0] Approving sales to the tune of thousands of guns a year.

If he didn't, then the person he got them from should be prosecuted to the fullest extent that the law allows.

He couldn't have gotten any firearm legally. It is against the law for a convicted felon to possess a firearm. The ATF already has laws on the books allowing and encouraging them to investigate and arrest such violations.

Instead, they were knowingly allowing thousands of guns to walk to criminal Mexico without intervening or making any arrests, all of the while writing memos to other offices that the US should use the gun violence in Mexico to encourage more laws to prevent/restrict lawful and non-criminal purchases.

This. When we start making mental health care as available as guns I believe we'll see a change.

But.

If bad people want to do bad things they will find a way. Regardless of how stringent or lax our gun laws are. There will always be those that slip through the cracks no matter how good our mental health care system is.

That's the thing, apparently the background check system that we and use incomplete records since it's a voluntary system with some states only putting up a 100 names as a token effort and others abstaining completely.

And in this day and age were we have nearly the whole of human history recorded on Wikipedia, instead of being able to type a name we have to have people phone calls and looking at scribbled notes or water damaged pages for these background checks.

This says that it could have been possible for him to have bought the firearms. We'll have to wait for the investigation to rule one way or another. If it was a black market sale, then it's just another tragedy.

I'm not sure if we need more hospitals either but just giving individuals easier access to mental health care would be better. Although there is current a social stigma attached to mental health issues. Doesn't matter how easy mental health care is to access, doesn't mean people will go. It doesn't matter if someone knows a loved one that might need help, doesn't mean they will take them or talk to them about getting help.
