Or you know the government could offer free dietary plans. Even providing a discount for all gym memberships would help. Telling people they cannot be fat any more because it is the law is counter productive. Give people reason and resources to become fit and some will take the offer up.

True enough, and in the case of the American Constitution it also relies on the basis of its formative works ... and in the State of Virginia one of those formative works was from Jefferson himself.

I think you've mistaken goal and role.

The governments role is to enforce the Constitution. The governments goal is to get reelected.

They should go about trying to achieve their goal by enforcing the constitution properly, but it's easier to pander and adjust the character of things. This is a fact, no matter what political party you affiliate yourself with.

Those laws are enforced by the police (not army, as some states may think)
The interpretation between the state, police and people is concluded by the judiciary.

The governments role is to represent the people.
Agree, that their goal is to get re-elected and/or create a pyramid power and/or wealth which will server them on the day they dont.
