It has the right to.
No it doesn't.

Texas Constitution states Texas is a "free, independent state subject only to the Constitution of the United States of America". Since there is nothing expressly forbidding the secession of states in the US Constitution, Texas has the right to secede.

Whether or not the government will try to conquer them after secession is a different issue. Reference

The Constitution says the judicial branch interprets the law and the Supreme Court says secession is not legal.

Studies show that men think about sex every 7 seconds. I do my best to eat hotdogs in under 6, just so things don't get weird.

Please allow me to introduce Myself
I'm a man of wealth and taste
I've been around for a long, long year
Stole many a man's soul and faith

I see further changes in Africa and the Middle East. As European Colonialism gets further in the past the old political lines as drawn by Europe will fade, and new countries will be created in their place.

  • 01.04.2013 11:21 AM PDT

Now let's get down to business, I don't got no time to play around, what is this?

I'm sensing a Byzantine/Holy Roman-esque split with the United States in the future.

I disagree. While America's problems are similar to those of the Holy Roman Empire, we have what they lacked to maintain order and security,

I know what you mean. They all hate us anyway because we didn't agree to that bank tax, of which 80% of the money it would make would come from us, and not benefit us.

Wasn't there a thing about Texas leaving?

It has the right to.

Not it doesn't. This is an urban legend with absolutely no proof.

Supremacy clause of the constitution.
Constitution says whatever the Supreme Court says, goes.
Supreme Court says no one has right to secede.

Very excellent point.

However, once the people of the seceding state confirm the secession, the state is an independent state, no longer subject to the Constitution of the United States.

I have modified my argument. I now believe it would be interesting to see how all of that gets sorted out if a secession ever gets considered.

Laws require enforcement. Any state seceding is knowlingly violating the law of the land. It would almost certainly result in another war.

I see no such clause in the US constitution.

Secession is an extra-legal act of self determination. It is "outside the law". Basically, the United States government wouldn't even be a party in the law suit.

But again, I would love to see how all the legal jargon gets sorted out if the topic of secession ever becomes a "hot topic".

  • 01.04.2013 11:31 AM PDT

Third World African countries, and probably some places in the middle east. That's about it.

I imagine there will be more new countries than old ones disappearing.

Is that really your argument?
A)Many states could not survive without the Union.
B)Secession needs the majority of citizens, and no event has ever inspired that much of a need to secede.
C)The Federal Government would likely declare war on the seceding state, wrecking the state's infrastructure and economy, forcing it back into the Union and rendering the secession as a waste.

It wouldn't matter. If a state secedes, it means it is no longer affiliated with the Mother Country, including its Constitution. So a clause within the Constitution wouldn't apply.

Now if there were a clause within the Constitution expressly forbidding secession, my argument would be null and void.

I just don't see why they would want to. These are countries (with the exception of Germany that used to be more small states) that have fought hard for their sovereignty over the ages.

Why would you come that nonsensical conclusion? Are you just trying to shoehorn some names that show you have 10th grade World History knowledge?
