Technically sure. But, the phone must have some sort of lock on it. Whether it be a picture lock or a code lock.

If her phone is locked and he's using it, it's considered invasion of privacy. I mean, it's invasion of privacy as it is right now, but OP will have a better case if her phone has a lock on it.

Try actually filling her in on what's going on. Show her the texts the clown sent to you from her phone. If she still wants to keep it hush-hush, then she's retarded and probably belongs with that piece of crap.

I'm probably not the best person for relationship advice (like... at all) but it seems to me that since both physical and legal action could create problems between you and your GF, you're best option is to fill her in completely(as others have said) as well as explaining that it's bothering you and ask her how she's ok with you handling it or, if she doesn't want you to handle it, ask her to. If she doesn't want you to handle it and won't handle it herself, I'm just gonna say it's probably not the best relationship.

Don't really understand why you wouldn't tell her everything anyways, I always thought that being completely honest and open with your partner was best, to eliminate problems, but like I said, I'm probably not the best person for advice on the subject.

The fact that she allows him to use her phone to send malicious messages throws up a huge red flag in my opinion. Either she doesnt know, or she knows.and doesnt care, and something is wrong in your relationship.

Man up and talk to her about the situation and how its affecting you. Harrassment is not something to take lightly, and if she knows what's up, she should take appropriate action.

Actually the best thing to do is get your girlfriend to talk to him, since he obviously feels the need to protect her from you. She should have no problem with it, unless she's telling him crap.

Pretty much what Duardo said. It's a relationship, and those are built on trust. I won't bash you, because this kind of situation causes anxiety and can be extremely awkward. Just tell her what's going on. Confronting the guy could only lead to physical problems. Tell her how you feel and explain the situation, otherwise she'll find out eventually if she doesn't already know and things will only get worse.

3. Guy replies as usual but it goes to his boss's phone.

I just did this and she said she was going to confront him at work but she didn't see him today.

She just put a passcode on her phone so he can't send any messages with her phone any more.
