I don't know who makes the decisions on these things, but Microsoft and/or Bungie should be very careful about this. Have they forgotten the rich modding community that Bungie had with the Marathon series? Infiniti was built with the concept in mind, and as Half-life has clearly demonstrated, letting modders do as they wish is very good thing. I've only just now heard of Halogen through Slashdot.com, and it was looking to be a very professional and well done mod. They had better offer a clear explanation - I can see why if they had plans for an RTS Halo down the road, they might not want this out there. But we need an answer, because otherwise a very poor message is being sent to all the Halo fans out there. Get your stuff together, Bungie - don't alienate your base.

The difference is that this is almost a direct copy of Halo onto another companies game. You can't do that legaly without permission. You can't do it with half life, nor with marathon.

The timeing is probably because they WERE close to releasing a beta. There would have been no problem if the project had failed, or never got close to releasing.

Milito, the mod was decided that it violated the Halo Intellectual Property. Yes, it looked like a very good mod, but they did not get permission to use items and charecters from the Halo Universe.

There was still no infringement. Not enough of the material was used, the mod falls under fair use - a term companies like Microsoft have no knowledge of. I guess just conceding is better than going to court with Microsoft or Bungie debating a subjective term such as fair use in front of a judge

HaloGen was a Halo game, meaning it took place in the Halo universe, was tied into the Halo story, and everything in it was made with the intent of being part of Halo. There was nothing about the mod that fell under fair use. The idea that, because they made unique vehicles as well is invalid, because the intent was that these vehicles were a part of the Halo universe, which is owned by Microsoft. The fact that it was a mod is irrelevant; that just means they didn't design the engine themselves.

It's really, really lame that it had to happen like this, but nobody should be particularly shocked. It happens all the time, when modders attempt to make a game based on some other group's game.

So Recon, what if the Halogen team presented their idea for the Halo RTS mod to you guys beforehand to get your permission? If you guys accepted it, would Microsoft still have sent out that cease and desist order?

If it had been in writing, then microsoft wouldn't be able to send that order. They could probably find another way to make them stop though.
